Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to everyone who uses Fyncall — primarily merchants who install Fyncall on their Shopify store (“Customer” or “you”), but also their team members and anyone they grant access. By using Fyncall you agree to comply with this AUP. Violations may result in suspension or termination of your account, in line with the Terms of Service.

The AUP is deliberately specific. The list below is not exhaustive — if something seems abusive in spirit, treat it as prohibited even if it isn’t named.


1. Lawful use only

You may only use Fyncall for lawful business purposes and in compliance with all laws applicable to you and your end customers. Specifically you must comply with:

  • All laws governing your industry, including consumer-protection, advertising, financial-services, healthcare, and product-safety laws applicable to what you sell.
  • All anti-spam laws, including the EU ePrivacy Directive, GDPR, the UK Privacy and Electronic Communications Regulations, the US CAN-SPAM Act, and Canada’s Anti-Spam Legislation (CASL).
  • All export-control and sanctions laws in your jurisdiction. Customers in countries subject to comprehensive sanctions (Cuba, Iran, North Korea, Syria, the Crimea / Donetsk / Luhansk regions of Ukraine) may not use Fyncall.
  • Shopify’s own Terms of Service and Acceptable Use Policy.

2. Prohibited content and conduct

You will not use Fyncall to:

2.1 Send unauthorised marketing or spam

  • Send messages over WhatsApp, SMS, email, or any other channel without the recipient’s prior opt-in (where required by applicable law) or another lawful basis.
  • Send bulk unsolicited messages.
  • Pretend to be a real human agent when in fact the message was generated by AI without making the AI nature clear when reasonably required.
  • Continue messaging a recipient who has asked to stop.

2.2 Sell or promote prohibited products

  • Sell, market, or arrange the sale of weapons, explosives, ammunition, or controlled drugs.
  • Sell, market, or arrange the sale of tobacco, vaping, or alcoholic products to people who cannot lawfully receive them.
  • Operate gambling, lotteries, or similar prize draws not authorised in the recipient’s jurisdiction.
  • Market or sell counterfeit goods, stolen property, or items that infringe a third party’s intellectual property rights.
  • Sell or recommend prescription medication, medical advice, or health treatments that fall outside the merchant’s licensed scope of practice.
  • Promote pyramid schemes, get-rich-quick schemes, or any other deceptive money-making program.

2.3 Misuse the AI

  • Configure the AI to make medical, legal, financial, or other professional decisions on behalf of customers in ways that exceed the merchant’s licence or expertise.
  • Use the AI to misrepresent products, prices, or terms (the AI must be configured against your real product catalog and policies).
  • Use the AI to manipulate, coerce, or deceive vulnerable individuals (e.g., minors, the bereaved, financially distressed individuals).
  • Use the AI to generate, distribute, or disguise content that is unlawful elsewhere in this AUP — e.g., asking the AI to draft phishing messages on your behalf.
  • Disable or bypass the AI’s safety guardrails in a way that exposes customers to risk.

2.4 Harm individuals

  • Harass, threaten, defame, dox, or stalk any person.
  • Discriminate against any person on the basis of any protected characteristic.
  • Distribute child sexual abuse material or content sexualising minors. (Confirmed instances will be reported immediately to the National Center for Missing & Exploited Children, the UK’s IWF, or the equivalent authority where you are located.)
  • Distribute non-consensual intimate imagery, “deepfake” pornography, or content created to humiliate a real person.
  • Promote self-harm, suicide, or violence.

2.5 Compromise security

  • Probe, scan, or test the vulnerability of any Fyncall system without our prior written permission. (Authorised disclosures are welcomed at security@fyncall.com.)
  • Bypass or attempt to bypass any authentication, rate-limiting, or access-control mechanism.
  • Send malware, links to malware, phishing pages, or any other code intended to exploit recipients.
  • Reverse-engineer, decompile, or scrape Fyncall in ways that exceed the licence in the Terms of Service.
  • Use Fyncall to launch denial-of-service attacks, resource-exhaustion attacks, or any other attack against any third party.
  • Resell, redistribute, or wrap Fyncall as a competing chatbot service without our express written permission.

2.6 Misuse personal data

  • Process personal data via Fyncall in a way that violates the Data Processing Agreement, the Privacy Policy, or applicable data-protection laws.
  • Provide Fyncall with personal data you have no legal right to share.
  • Process special-category personal data (health, biometric, religious, sexual orientation, etc.) at scale without taking the additional safeguards required by GDPR Art. 9 / equivalent law.
  • Use Fyncall to track or profile individuals without a lawful basis.

2.7 Misuse the Shopify integration

  • Misrepresent your relationship with Shopify or any other platform we integrate with.
  • Use Fyncall to circumvent Shopify checkout, take payments outside the Shopify Billing API in violation of Shopify’s terms, or otherwise act contrary to Shopify’s Acceptable Use Policy.
  • Submit false or misleading information to Shopify (e.g., a fake support email, a fake demo store) on a Fyncall-driven submission.

3. Volume and rate limits

To keep the service performant for everyone, Fyncall enforces rate limits, message-volume thresholds, storage quotas, and API request limits. The current limits are documented in your plan and may change from time to time. You will not:

  • Attempt to evade these limits (e.g., by creating multiple accounts).
  • Use the service in a way that imposes a disproportionate load on Fyncall’s systems (excessive concurrent requests, very large attachments, deeply nested workflow loops).

We will work with you in good faith if your legitimate use exceeds your plan’s limits and offer an upgrade or quota adjustment.


4. Reporting violations

If you believe someone is using Fyncall in violation of this AUP, please report it:

  • Email: abuse@fyncall.com
  • For security vulnerabilities: security@fyncall.com
  • For child-safety reports that need to be escalated immediately: safety@fyncall.com — these are routed to a small on-call group for fast triage.

We aim to acknowledge abuse reports within 2 business days and to action them in line with their severity.


5. Enforcement

If we believe you are violating this AUP, we may, depending on severity:

  • Contact you to discuss the issue and ask you to remedy it within a reasonable period.
  • Restrict specific features (for example, suspending outbound WhatsApp sends).
  • Suspend your account temporarily.
  • Terminate your account and delete all associated data, in line with the Terms of Service.
  • Report you to the relevant authorities if the conduct is illegal.

For severe violations (illegal content, child safety, active security attack), we may act without prior notice.

We will, where reasonably possible, give you the opportunity to respond before terminating an account, except where prior notice would itself cause harm or is prohibited by law.


6. No waiver

Our failure to enforce any provision of this AUP does not waive our right to enforce it later or in similar circumstances. The fact that we may not have noticed prior violations does not give you a right to continue them.


7. Changes

We may update this AUP from time to time. The “Last updated” date at the top will reflect the most recent change. Material changes will be communicated to you by email at least 14 days before taking effect, unless the change is required to address an immediate legal or safety risk.
